Key Points
- You authorize Algovested to connect to your broker account and execute trades on your behalf using the API credentials you provide.
- You represent and warrant that you are authorized to provide the broker API credentials and that the account is lawfully held by you (or those you have legal authority for).
- Algovested stores broker API credentials encrypted and will not have access to plaintext credentials in normal operation. You explicitly authorize Algovested to use these credentials to place orders and view balances/holdings.
- Algorithmic orders will be tagged and logged in accordance with exchange / SEBI requirements; Algovested and the broker may suspend or halt orders to comply with exchange rules or to mitigate risk.
- Investing and automated trading involve risk; past performance does not guarantee future returns. Algovested does not provide personalized financial advice unless explicitly contracted.
- Fees, billing, refunds and fee-sharing with brokers/algo-providers must be disclosed prior to service activation.
- Limitation of liability: Algovested's aggregate liability is capped (configurable placeholder: 'fees paid in previous 12 months' or a fixed cap). Certain statutory liabilities and injunctive relief carve-outs remain.
- Indemnity: Users indemnify Algovested for third-party claims arising from misuse of credentials, fraudulent instructions, or breach of representations.
- Dispute resolution: Mandatory arbitration (seat: configurable) under Indian law; injunctive relief exceptions allowed for IP/confidentiality violations.
- Termination & suspension: Algovested may suspend accounts for regulatory, security or exchange requirements; users can terminate but outstanding obligations survive.
Service Description & Authorization
- You grant Algovested a limited, revocable right to use the encrypted API credentials to place orders, check balances and holdings, and receive trade confirmations.
- You authorize automated decision-making by the algos you opt into. You may opt for human review where offered.
Credential Handling & Security
- All API credentials are treated as sensitive data and stored encrypted with an industry-standard key management system (KMS/HSM). Only authorized runtime components may decrypt inside a hardened environment for execution.
- We implement secrets rotation, least privilege, access logs and multi-person control for critical key operations.
- Algovested does not access or read plaintext credentials as a matter of routine operations; technical exceptions (incident response) are noted below and will be logged and audited.
Regulatory & Exchange Compliance
- Algovested will follow exchange/SEBI requirements: order tagging, empanelment rules for algo providers, static-IP whitelisting where required, and 2FA/OAuth-based auth models.
- Users acknowledge that SEBI/exchanges may require registration/empanelment or limits on certain algos (white-box/black-box categorization) and agree to cooperate with such onboarding or testing.
- Algovested will share required information with exchanges or brokers for compliance or investigation when legally required.
Risk, Disclaimers & No Financial Advice
- Automated trading may result in significant losses. You accept the risks and will not hold Algovested liable beyond the liability cap stated elsewhere.
- We are not SEBI registered, this is a tool, invest at your own risk.
- Algovested provides platform and execution services; personalized investment advice only when documented in a separate client agreement.
Limitation of Liability & Indemnity
- Liability cap: configurable (default placeholder: fees paid in last 12 months).
- Users indemnify Algovested against claims arising from unauthorized sharing of credentials, failure to comply with broker/exchange terms, or violation of laws.
Data retention, Logs & Audit Rights
- Algovested will retain order logs, audit trails and connectivity logs for a minimum period required by law/exchange (configurable).
- We will provide access to logs for regulatory investigations or as required by court order.
